Careful Contracting for Design-Builders
Presented by: Steve Mroczkowski, Dykema Webinar Recording The use of design-build project delivery has increased in recent years, both for public and private projects. As this method of project delivery becomes more common, it is important for contractors entering into design-build contracts to fully understand default standards of care for design work and construction work as detailed in form contract documents. This brief presentation will explore some standard design-build contract provisions and how these provisions identify standards of care for design work and construction work. Not all contracts are created equal and contract provisions identifying these standards should be carefully reviewed and, when necessary, modified so that contractors are not subjecting themselves to higher, improper standards of care under their contract and potential liability gaps. Steve Mroczkowski is the consummate outside construction counsel, drafting, reviewing, and negotiating contracts for clients ranging from large corporations to small closely held companies, but primarily litigating disputes in state and federal courts and mediation and arbitration proceedings.
As co-leader of Dykema’s construction team, he regularly advises clients on issues involving breach of contract, lien and bond claims, defects, defaults, complex commercial foreclosures, lease disputes, liquidations, bankruptcy preference, and fraudulent transfers. |
